You agree to take full responsibility for ensuring your account and its details are securely maintained at all times and to take necessary steps to prevent misuse of your account. You further agree and acknowledge that we are only a facilitator and are not a party to or in control of any transactions carried out on the Site or through a payment gateway provided by an independent service provider.
Accordingly, the contract of sale for products on the Site is strictly a bipartite agreement between you and Abir Shop. Payment processing occurs between you and the service provider, and in the case of prepayments with electronic cards, it also involves your issuing bank. As such, the contract for payment on the Site shall be strictly a bipartite contract between you and the respective payment service provider listed on our Site.
D. CONTINUED AVAILABILITY OF THE SITE
We will make every effort to ensure that access to the Site is consistently available, uninterrupted, and error-free. However, due to the nature of the Internet and the functioning of the Site, uninterrupted access cannot be guaranteed.
Additionally, your access to the Site may occasionally be suspended or restricted to allow for repairs, maintenance, or the introduction of new features, facilities, or services. Such interruptions may occur at any time without prior notice. We will, however, strive to minimize the frequency and duration of any such suspensions or restrictions.
E. LICENSE TO ACCESS THE SITE
By accessing the Site, you confirm that you are capable of forming legally binding contracts, which means you confirm that you are at least 18 years of age or are accessing the Site under the supervision of a parent or legal guardian. link for commercial purposes without express written permission. You agree not to engage in the following restricted activities, which may lead to the immediate cancellation of your account, orders, reviews, or other transactions

    Threatens the unity, integrity, security, or sovereignty of Bangladesh or friendly relations with foreign States.
    Is objectionable, unlawful, or contains viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.”

    Using the Site in violation of these restrictions will result in immediate action, which may include the termination of your account, cancellation of orders, or legal action, depending on the severity of the violation.
    G. DISCLAIMER
    You acknowledge and agree that by accessing the services on the Site and conducting transactions, you are doing so at your own risk and are using your best judgment before entering into any transactions through the Site. We shall not be liable or responsible for any actions or inactions of third-party sellers, nor for any breach of conditions, representations, or warranties by sellers or manufacturers of products. We hereby expressly disclaim all responsibility and liability in such matters. Additionally, we shall not mediate or resolve any dispute or disagreement between you and the sellers or manufacturers of the products.
    We further expressly disclaim any warranties or representations (express or implied) regarding the quality, suitability, accuracy, reliability, completeness, timeliness, performance, safety, merchantability, fitness for a particular purpose, or legality of the products listed, displayed, or transacted on the Site. While we have taken precautions to minimize inaccuracies in the content, this Site, all content, information (including product prices), software, products, services, and related graphics are provided on an “as-is” basis, without any warranty of any kind.
    We do not implicitly or explicitly support or endorse the sale or purchase of any products on the Site. At no time shall any right, title, or interest in the products sold through or displayed on the Site vest with Abir Shop, nor shall we have any obligations or liabilities in respect of any transactions on the Site. Furthermore, we shall not be liable or responsible for the actions or inactions of any other service provider listed on our Site, including but not limited to payment
    providers, installment services, warranty services, or any other associated services.
    H. THIRD PARTY BUSINESSES
    Parties other than Abir Shop and its affiliates may operate stores, provide services, or sell product lines on the Site. For instance, businesses and individuals may offer products through the Marketplace. Additionally, we provide links to websites of affiliated companies and certain other businesses. We are not responsible for examining or evaluating, nor do we warrant or endorse the offerings of any of these businesses or individuals, or the content of their websites. We do not assume any responsibility or liability for the actions, products, or content of these third parties or any other third parties. You can identify when a thirdparty is involved in your transaction by carefully reviewing your transaction details. We may share customer information related to those transactions with the third-party involved. You should carefully review their privacy policies and related terms and conditions before engaging in any transactions.
  4. H. YOUR SUBMISSION

Anything that you submit to the Abir Shop Site and/or provide to us, including but not limited to questions, reviews, comments, and suggestions (collectively. “Submissions”) will become our sole and exclusive property and shall not be returned to you. In addition to the rights applicable to any Submission, when you post comments or reviews to the Abir Shop Site, you also grant us the right to use the name that you submit in connection with such review, comment, or other content. You shall not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties regarding the origin of any Submissions. We may, but shall not be obligated to, remove or edit any Submissions without notice or legal recourse applicable to us in this regard.
  6. I. CLAIMS AGAINST OBJECTIONABLE CONTENT
  7. We list a variety of products for sale offered by numerous sellers on the Abir Shop Site and host multiple comments on product listings. It is not possible for us to be aware of the contents of each product listed for sale, or each comment or review displayed. Accordingly, we operate on a “claim, review and takedown” basis. If you believe that any content on the Abir Shop Site is illegal, offensive (including but not limited to material that is sexually explicit or promotes racism, bigotry. hatred, or physical harm), deceptive, misleading, abusive, indecent, harassing, blasphemous, defamatory, libellous, obscene, pornographic, paedophilic, menacing; ethnically objectionable, disparaging; or is otherwise harmful to third parties; or relates to or promotes money laundering, gambling, or harm to minors in any way: or impersonates another person; or threatens the unity, integrity, security, or sovereignty of Bangladesh or its friendly relations with foreign states; or any content that is objectionable or otherwise unlawful in any manner whatsoever; or which consists of or contains software viruses, (“objectionable content”), please notify us
  8. immediately by writing to us at legal@abirshop.com. We will make all practical efforts to investigate and remove valid objectionable content complaints within a reasonable amount of time.

Please ensure to provide your name, address, contact information, and as many relevant details about the claim as possible, including the name of the objectionable content party, specific instances of objection, and any proof of objection. Please note that providing incomplete details will render your claim invalid and unusable for legal purposes.
  10. J. CLAIMS AGAINST INFRINGING CONTENT
  11. We respect the intellectual property of others. If you believe that your intellectual property rights have been used in a way that gives rise to concerns of infringement, please contact us and we will make all reasonable efforts to address your concern within a reasonable amount of time. Please ensure to provide your name, address, contact information, and as many relevant details of the claim, including the name of the infringing party, instances of infringement, proof of infringement, and any other relevant information. Please note that providing incomplete details will render your claim invalid and unusable for legal purposes. In addition, providing false or misleading information may be considered a legal offense and may lead to legal proceedings. We also respect a manufacturer’s right to enter into exclusive distribution or resale agreements for its products. However, violations of such agreements do not

P. Return Policy

are committed to providing a satisfactory shopping experience. To ensure our customers are happy with their purchases, we offer the following return policies:
if you are not completely satisfied with your purchase, you can return it within 7 days from the date of delivery.
To be eligible for a return, the product must be in its original condition, unused , and with all packaging intact. Please contact us within 7 days of receiving your product to initiate the return process.
Return shipping charges will be the responsibility of the customer unless the item is defective or incorrect.

    For items purchased from Abir Mall Shop, we offer an extended return window of 14 days. The product must be returned in its original condition, unused, and with all packaging intact.
    Please contact us within 14 days of receiving your product to initiate the return process.
    Return shipping charges will be borne by the customer unless the item is defective or incorrect

  2. 1.1 All users and buyers of the Abir Shop Online Platform (the “Buyers”) are expected to conduct themselves in accordance with this Buyer Policy, in addition to the Abir Shop Platform Terms of Use and all applicable terms and conditions, all of which are incorporated by reference in this Buyer Policy.
    1.2 We are committed to building a trusted and reliable platform for our community, and the Buyer Policy ensures that the Abir Shop Online Platform operates in a
    safe and orderly manner, with the aim of creating a pleasant shopping experience for all users.
  3. Policy and Enforcement
  4. 2.1 A Buyer shall comply with the rules set out in Table 1.
    2.2 If a Buyer fails to comply with the rules, Abir Shop may take any one or more of the following actions without further notice or warning: a. Suspend, cancel, terminate, block, or reverse any transaction carried out by the Buyer on the Abir Shop Online Platform:
    b. Amend or remove affected messages or content: remove any feature available to the Buyer: and/or remove (in whole or in part) the Buyer’s access to the Abir
    Shop Online Platform; and/or c. Restrict, suspend, or terminate the Buyer’s Abir Shop account.
    2.3 The rules set out in Table 1 are non-exhaustive, and Abir Shop reserves the right to take further enforcement action, including filing reports with regulators or
    law enforcement agencies, if any misconduct by a Buyer is found.

    Transaction
    Honor all agreements made through the official communication channels on Abir Shop.

    All transactions must be completed within Abir Shop. Do not engage in offline payments or transactions outside of the platform.
  • Do not provide false or incomplete shipping addresses, or reject delivery acceptance. If the product is defective or incorrect, accept delivery and follow the Abir
    Shop Return Policy.
    Post-Transaction
  • Provide honest feedback about products and services.
    Do not post untrue, fake, or inappropriate reviews or content that violates any law. – Do not initiate payment disputes if a refund has already been issued for the item.

R. Cancellation Policy
Abir Shop retains the right to cancel any order at its sole discretion before dispatch and for any reason, including but not limited to the following:
Product being mispriced.
Product being out of stock or discontinued.
Product being expired, defective, or malfunctioning
If your order is cancelled, we will notify you as soon as possible, and if applicable, any payment made for the order will be refunded according to our refund policy.
Incorrect product information or description due to technical or typographical errors, Any other reason that might prevent the order from being processed or delivered correctly.
S. Refund
In case of any cancellations of any order(s) due to inevitable circumstances, the paid amount will be refunded to the customer’s balance first. The customer needs to report an issue under the refund category and mention the desired refund type (e.g., Bkash/bank) along with details (Bkash personal number, bank account details).
The customer will be disqualified from any offers or cashback associated with the particular order.
If the customer cancels their order, they will be eligible for a refund. The refund process may take up to 30 working days or more depending on the payment service depending o gateway provider’s clauses. The refund will be initiated through the same payment channel, i.e.. if the customer paid via Bkash, the refund will be processed through Bkash. The customer cannot be refunded via any other payment channel. However, Abir Shop retains the right to consider or reconsider refund via another flexible channel(s) to expedite the process or make it easier for the customer.
The customer will not be eligible for any extra cashback or bonuses against their principal amount in case of refunds. Abir Shop is not responsible for paying any kind of service charge or cost for the refunded amount.
